Will of Jean Holburne
Description
The Will of Mrs. Jean Holburne, described as "Disposition by Mrs. Jean Holburn to Admiral Francis Holburn, 1760." Registered as a probative will by Alexander Symes, Edinburgh, in the Books of the Session Office,1763.I, Mrs. Jean Holburn, daughter of the deceased Sir James Holburn of Menstrie Baronet for the love favour and affection which I have and bear to Admiral Francis Holburn my brother German and other Considerations me hereunto moveing Do hereby with and under the burthen of the Payment and Delivery of the Legacies after mentioned Give Grant Assign and Dispose to and in favour of the said Admiral ffrancis Holburn and his heirs and successors whoatsoever all Lands Heritages Annual rents Adjudications Heritable Bonds and whole other Heritable Estate as also all and sundry Debts and somes of money Bonds Bills tickets Accounts Gold and Silver Coined and Uncoined and whole other Personall Estate of whatever Nature or Denomination the same may be pertaining and owing or which may be addebted and owing to me the time of my Decease with the whole Writes and Evidents of and Concerning the same and have clauses therein contained providing and declaring always as it is hereby provided and decalred that the said Admiral Francis Holburn and his for-said by their Acceptation hereof and expressly burthened with the payment and delivery of the following legacies:- To Will to Sir James Clerk of Pennycuik Baronet the sum of one hundred guineas of gold - the deceased Sir John Clerk of Pennycuik Baronet in my favours and which Bond or Obligation I hereby ordain to be delivered up to the said Sir James Clerk immediately after my Decease. Item to Joanna Clerk lawful daughter of George Clerk Maxwell of Middlebie Esquire my Gold Watch which was left to me in a Legacy by the deceased Lady Clerk and which Gold Watch I likewise ordain to be delivered to the said Joanna Clerk immediately after my Death. Item to Mrs. Janet Holburn my sister German spouse to James Campbell Merchant in Leith the Sum of fifty Pounds Sterling. Item to Archibald Campbell my Nephew Son of the Deceased Commssioner Colin Campbell the Sum of (end of first page, signed Jean Holburne)one hundred Pounds Sterling. Item to Katherine and Janet Campbell my Nieces Daughters of the said Comissioner Colin Campbell the Sum of fifty pounds Sterling to each of them. Item to Mrs. Warburton Campbell spouse of Captain John Bedolph of His Majestie's Regiment of Foot called the old Buffs the sum of Twenty five pounds Sterling And to Sir John Clerk Merchant in Edinburgh the sum of twenty five pounds Sterling Declaring Nevertheless that in Regard the funds out of which I appoint the last six mentioned Legacies to be Paid to the said Janet Holburn Archibald Janet Katherine and Warburton Campbells and John Clerk are a part of the Means and Effects that were bequeathed to me by the Deceasd Captain William Holburn my Brother German by her Settlement Bearing date the twnety fifth day of September one thousand seven hundred and fifty nine years which at Present is liferented by Mrs. Margaret Kirkwood Therefor the said six legacies are hereby only Declared to be payable on the Decease of the said Margaret Kirkwood in Case she survive me and at my Decease in the Event I survive her and moreover I oblige me my heirs and Successors to grant all writes Requisite and Necessary for vesting the Premises in the Person of the said Admiral Francis Holburn and his forsaids And for rendering such these Presents the more Effectual so far related to my Moveable Estate I hereby Nominate and appoint the aforsaid Admiral Francis Holburn and his forsaids to be my Sole Executors and I Dispence with the Generality hereof and Admitt & declare these Presents to be a Valid and Effectuall as if each Particular of the Premises were herein specially enumerated and further I hereby Recall all former Settlements and Burthen these Presents with the Payment of(end of second page, signed Jean Holburne) of all my Just and Lawfull debts and Reserve full power to myself at any time in my life and Even in the Article of Death to alter or Innovate the same in whole or in part as I shall see fit Dispensing allways with the new Delivery hereof and Admitting and Declaring the same to be Valid and Effectuall wherever the same may be found at my death and I Consent to the Registration hereof in the Book of Council and Session or any other Judges Books Competent therein to remain for preservtaion and for that End Constitute My Provs & In Witness whereof I subscribe this and the two preceding Pages whereof these Presents do consist all wrote on stamped paper by Alexander Syme Clerk Clerk to James Carmichael of Hailes writer to the Signet Att Edinburgh the ninth Day of September one thousand seven hundred and sixty year before these Witnesses the said Mr. James Carmichael and Alexander Syme writer hereofJean HolburneJa: Carmichael WitnessAlexander Symer Witness.
